Packaging Waste Legislation Regulators

The Environment Agency (EA), Scottish Environmental Protection Agency (SEPA), Natural Resources Wales (NRW) and the Northern Ireland Environment Agency (NIEA) actively enforce the Packaging Regulations by auditing registered companies and by targeting “free-riders”.These are companies who fail to comply with the Regulations and who will be subject to enforcement action.

The highest fine received so far was by Red Bull. This company was found to be in breach of the Regulations and charged £271,800 in fines, compensation and court costs.

Once registered with a Compliance Scheme the EA seeks to audit obligated companies within three years of first registration and then approximately every 3 years thereafter on a risk basis.

As your Compliance Scheme Kite will liaise with the Agencies on your behalf and this includes attending and supporting you during any packaging audits should you require this service.
