As far as these Regulations are concerned, your obligation has nothing to do with the volume of waste generated at or removed from your site, whether that waste is recycled or sent to landfill.

Your obligation is solely dependent on the weight of packaging you are introducing into the UK system.

Case Study A: We are an office and don’t handle the goods at all!

Company
“We act as a sales office within the UK. All the goods are supplied directly from our overseas suppliers or distribution centres so we aren’t handling any packaging at all. How can we be obligated?”

Regulations
Selling packaged goods to your customer in the UK is an obligated activity. You are affected even if you don’t physically touch the goods. If the packaging around these goods exceeds the 50 tonne threshold and your company has a turnover above £2m you will be obligated.

Case Study B: We don’t pack the goods or add packaging!

“We only supply on goods which are already packed so we don’t have an obligation do we?”

Regulations
If you sell packaged goods to your customers you pick up an obligation if these goods are imported or where the customer removes some, or all, of the packaging, irrespective of whether you handle the goods yourself. If the packaging around these goods exceeds the 50 tonne threshold and your company has turnover above £2million you will be obligated.

Case Study C: Our customers ask us for weights. If they are doing this do we have to do it as well?

Regulations
The supply chain for packaging is split into staged activities, each attracting an obligation. You, your supplier and your customer could be picking up different obligations on the same packaging and all need to register.

Case Study D: We import all our goods.

Regulations
The Regulations work on the basis of packaging that is introduced to the UK by a company. This includes packaging around raw materials, components and finished goods. Where companies import packaging around goods they pick up additional obligations, rather than fewer.

Case Study E: We have over 10,000 product lines. How do we assess that?

“We sell a wide variety of products to our customers in very different packaging. We would have to hire somebody to weigh all the packaging around those products. ”

Regulations
Your data has to be as accurate as reasonably possible to pass an Environment Agency audit. This does not mean you need to weigh all the packaging you handle. .

Case Study F: We are a packaging company, how does this affect us?

“We supply packaging to our customers who use it to package their goods”

Regulations
You pick up an obligation on any packaging you manufacture or import as well as the surrounding packaging. If you distribute finished packaging goods within the UK they may not be obligated. In addition your customers may request information on the weights of packaging you sell to them for their use.
